The STJ overturned the TJDFT ruling regarding fraud charges against Flamengo forward Bruno Henrique, requiring a new analysis of the case’s legal deadlines.

The legal situation involving Flamengo forward Bruno Henrique took a new turn following a decision by the Superior Court of Justice (STJ). The court granted the request from the player’s defense team and overturned the previous decision regarding the fraud charge.

The ruling was issued by Reporting Justice Joel Ilan Paciornik, who identified the lack of analysis on a central point raised by the defense. The appeal specifically addresses the legal deadline for the alleged victims to formally express their intent to press charges against the player.

Despite the favorable procedural development, the ruling does not mean the Rubro-Negro player has been acquitted. The lawsuit regarding sports competition manipulation remains active independently and will continue to move forward in the Federal District courts.

The Defense’s Argument and Legal Deadlines

According to Bruno Henrique‘s defense team, the fraud charge is invalid because the six-month deadline for sportsbooks to formally file a complaint expired before the formal indictment.

According to the argument, the betting companies initially notified integrity monitoring bodies such as IBIA and Sportradar, as well as the CBF, taking too long to report the matter to the Federal Police and the Public Prosecutor’s Office.

The Federal District court had previously ruled that the initial alerts were sufficient to prove intent to investigate. Now, state judges will be required to thoroughly reevaluate that timeline of events.

The defense argued:

If the statute of limitations began with the initial alerts, it expired before the formal complaint, preventing the fraud charge from proceeding.

Understanding the Charges Against the Player

The investigation conducted by the Public Prosecutor’s Office of the Federal District and Territories (MPDFT) alleges that the player intentionally received a yellow card during a match against Santos in 2023.

Information from the inquiry indicates that relatives of the forward were allegedly tipped off in advance to place bets on the penalty. On one platform, nearly all bets placed on cards during that match were targeted at the player.

In addition to fraud, sports manipulation is classified under Brazil’s General Sports Law, carrying penalties of up to six years in prison. The forward denies any involvement in illegal activities.

On-Field Situation and Future Developments

On the pitch, the disciplinary impact was mitigated after the STJD converted the player’s initial suspension into a fine of R$ 100,000.

With his clearance in the sports jurisdiction, Bruno Henrique remains available for Flamengo in their upcoming Brazilian Serie A fixtures this season.

The legal outcome regarding the fraud charge now depends on a new ruling by the TJDFT, which will determine whether the charge will be permanently dismissed or maintained in the criminal case.
